2. Legal Bases for Processing
The processing of personal data requires a legal basis, which we would like to explain below.
For the processing of personal data for which we obtain the consent of the data subject, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.
For the processing of personal data that is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) GDPR serves as the legal basis. This also includes processing operations that are necessary to carry out pre-contractual measures.
Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override the aforementioned interest, Article 6(1)(f) GDPR serves as the legal basis for processing. Our company's legitimate interest lies in conducting our business activities as well as in analysing, optimising and maintaining the security of our online services.
II. Log Files
Our server statistics automatically store data that your browser transmits to us as part of our legitimate interest in analysis and for security reasons (so-called “log files”).
This includes the following data:
- Language and version of the browser software
- Operating system used and its interface
- Referrer URL (the page visited previously)
- Hostname of the accessing computer (IP address)
- Date and time of the server request
- Time zone difference from Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Amount of data transferred
- Access status / HTTP status code.
As a rule, we cannot assign this data to specific individuals. This data is not combined with data from other sources. The data is also deleted within 7 days following statistical evaluation. Data whose further retention is required for evidentiary purposes is exempt from deletion until the respective incident has been finally clarified.
III. Contractual Processing
The personal data you provide, such as your name, address or email address, is used internally only to answer your enquiries, process your orders or provide you with access to certain information.
IV. Cookies
This website uses cookies. Cookies are small text files stored on your computer through which the entity setting the cookie receives certain information. They are used to make the online services more user-friendly and effective and/or to facilitate navigation on our website.
This website uses cookies to the following extent:
- Transient cookies (temporary use)
- Third-party cookies (from the third-party provider Google Maps)
Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. These store a so-called randomly generated session ID, which allows various requests from your browser to be assigned to the same session. This enables your computer to be recognised when you return to our website.
Persistent cookies stored on your computer are automatically deleted after a predefined period, which may vary depending on the cookie.
Of course, you can also use our website without accepting cookies. You can configure your browser settings according to your preferences and, for example, reject the acceptance of third-party cookies or all cookies altogether, or delete cookies that have already been stored. Please note that if you do not accept cookies, our services may not function properly in some circumstances.
You can find out below which functions on our website set cookies and which cookies they use.
V. Rights of the Data Subject
• Right of access by the data subject (Art. 15 GDPR)
You have the right to obtain information from us about which data relating to you we process.
• Right to rectification (Art. 16 GDPR)
If the data concerning you is incorrect or incomplete, you may request the rectification of inaccurate data or the completion of incomplete information.
• Right to erasure (Art. 17 GDPR)
Under the conditions of Art. 17 GDPR, you may request the deletion of your personal data. Your right to deletion depends, among other things, on whether we still require the data concerning you to fulfil statutory or other obligations.
• Right to restriction of processing (Art. 18 GDPR)
Under the conditions of Art. 18 GDPR, you may request the restriction of processing of your personal data.
• Right to data portability (Art. 20 GDPR)
At your request, we will provide you with your personal data in a structured, commonly used and machine-readable format or transmit it to another data processor designated by you.
• Right to object (Art. 21 GDPR)
You have the right granted by the European legislator to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Article 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions within the meaning of Art. 4 No. 4 GDPR.
In the event of an objection, our company will no longer process the personal data concerned unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
If our company processes your personal data for the purpose of direct marketing, you have the right to object at any time to the processing of personal data for such advertising purposes. This also applies to profiling insofar as it is connected with such direct marketing. If you object to our processing of your personal data for direct marketing purposes, we will no longer process the personal data for these purposes.
You also have the right, on grounds relating to your particular situation, to object to the processing of your personal data carried out by us as the data controller for scientific or historical research purposes or statistical purposes pursuant to Art. 89(1) GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.
To exercise your right to object, you may contact any employee of our company directly. You are also free, in connection with the use of information society services and notwithstanding Directive 2002/58/EC, to exercise your right to object by means of automated procedures using technical specifications.
• Right to withdraw consent (Art. 7(3) GDPR)
You have the right to withdraw your consent to the processing of your personal data at any time. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
• No automated individual decision-making, including profiling
You have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling. Our company does not use automated decision-making or profiling.
• Right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of your personal data violates this Regulation.
You have the right to obtain information about the personal data stored about you by us. Under the statutory provisions, you also have the right to rectification of inaccurate data, restriction of processing, data portability and deletion of your personal data. To do so, send an email to datenschutz@tws-truckwash.de with the subject line "Data Protection".
You also have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates the applicable legal provisions. The supervisory authority responsible for us is: The Hamburg Commissioner for Data Protection and Freedom of Information, Ludwig-Erhard-Straße 22, 7th floor, 20459 Hamburg,
mailbox@datenschutz.hamburg.de,
www.datenschutz-hamburg.de.
If you have given your consent, you have the right to withdraw your consent at any time. This does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
You may object to the future processing of your personal data at any time in accordance with the statutory requirements. The objection may in particular be made against processing for direct marketing purposes.
VI. Retention Period for Personal Data
We store personal data for the duration of the respective statutory retention period. After the expiry of this period, the data is routinely deleted unless it is still required for initiating or fulfilling a contract. If user data is not deleted because it is required for other legally permissible purposes, its processing is restricted. The data is accordingly blocked and not processed for other purposes. This applies, for example, to user data that must be retained for commercial or tax purposes.
VII. Security Information
We make every effort to process your personal data using all available technical and organisational measures in such a way that the requirements of data protection laws are complied with and the data is protected. Our website and communication with us via our website are encrypted using HTTPS. Our website is hosted exclusively on servers (Ionos) in Germany.
